Role of a criminal defense lawyer has been glorified and belittled in many Hollywood movies. However, based on my opinion the truth lies somewhere in between these two drastically different descriptions. A criminal defense attorney needs to know where to look for information helping his/her client, how to uncover hidden information and how to present that information to the prosecutor, the judge and ultimately the jury without offending either of the three or the general public. This can be a very delicate balance to meet and in most instances nothing about this process if glamorous while in most instances it is honorable. To begin with to do justice to the client a defense attorney must be able to operate as a zealous advocate without being affected by the nature of the proceedings. Take accusations of child molestation (Penal Code section 288) or sexual abuse as an example. See www.criminaldefenseteamusa.com/california-crimes-sex-crimes.html. A defense attorney who has been approached to defend one accused of these crimes or being investigated for them needs to set emotions aside, completely. First decision to be made by the attorney is whether to provide the client accused of a sex crime, i.e. child molestation, underage sex (Penal Code Section 261.5,) sexual battery (Penal Code Section 243), rape (Penal Code Section 260), for an interview with the investigators and whether to allow the authorities to take DNA samples from him/her or search his house and belongings without a court order. The next decision is to whether a defense investigation should start without charges having been filed. A good investigator is almost as important a good attorney. I would also recommend hiring a good forensic expert to preserve evidence and to analyze evidence gathered by authorities. These experts can test semen samples, blood samples, help review the “rape kit” results, analyze the scene and provide invaluable support to a legal team. Criminal Defense Team approaches each criminal case with the proceedings rules in mind and puts together a knowledgeable team to help defend our clients. www.criminaldefenseteamusa.com.
